Understanding The EB-5 Program
Under the EB-5 Program, a foreign investor may file an immigrant petition (I-526) to show that they have backed $1 million in a “new commercial enterprise” that will create 10 full-time jobs in the U.S. The required investment amount may be reduced to $500,000 if the investment is in a rural area, or in an area with a high unemployment rate compared to the national average. After a petition is accepted, the investor, spouse and unmarried children under age 21 can apply for permanent residence.
Overcoming Investor Challenges
Some of the biggest challenges for EB-5 investors typically include:
- Determining which EB-5 project to invest in
- Demonstrating that the invested funds come from legitimate sources
- Demonstrating that the jobs in a project are created within the duration of the petition approval
